The spell checker is a commercial add on and is only available in
Netscape 6. A check is made for the presence of the spell checker and if
it is present a spell checker button appears in the toolbar.
The same check should be made in the prefs dialog and no spell checking
item should be displayed if the spell checker isn't installed.

If you'd like the spell checker but want to keep to the latest mozilla
rather than Netscape 6 you can try downloading the spell checker
separately - this is not guaranteed to work.
ftp://ftp.netscape.com/pub/netscape6/english/6.0_netbiz_edition/windows/win32/xpi/spellchk.xpi
That is for the win32 version, if you're using Linux/Mac look elsewhere
in the appropriate directories.
Just clicking on that link in Mozilla shoul launch the installer,
restart Mozilla to see if it works.
