You may be well aware of the issue of several major music related websites recently 
being sued on grounds of copyright infringement. This is occurring because these sites 
were accused of allegedly storing and distributing copyrighted music files. Often 
artists may incorporate samples from movies, television, games, and/or other 
musicians, etc. in their work. What they may not be aware of is the legal impact this 
can have not only on them but on the site that is hosting their music as well. If an 
artist or entity that legally owns the right to a piece of music or sample discovers 
that their copyrighted work is being used without proper permission, they are well 
within their rights to take legal action. They can choose to file a lawsuit against 
the site hosting the material in question as well as the artist who created it. This 
could result in heavy monetary fines or the closure of the site hosting the files. We 
at Trax in Space always have the best interests of our artists on our minds. Because 
of this, we reserve the right to remove any track on TiS that is found to include 
copyrighted samples or music. To further accommodate the artists, we understand that 
not all artists may be totally aware of the copyright laws that protect digital music 
and samples, therefore if an artist�s work is found to have copyrighted samples, the 
artist will be given 30 days in which to remove these samples and upload a new file 
without them. During this time the work in question will be put on hold and will be 
out of sight from Trax In Space visitors. If an artist claims that he/she has 
permission to use a copyrighted sample, the artist will need to provide Trax In Space 
with an expressed written copy of permission to distribute the song in question from 
the legal copyright holder, along with their contact information. Trax In Space may 
verify with the legal copyright holders to make sure that the documents are valid.

Q: Trax in Space never questioned me about songs I had in the past with copyrighted 
samples, why are they now suddenly removing them?

It is your responsibility to make sure you can legally distribute your work. If we do 
find that any song of yours violates any of our policies, we reserve the right to 
immediately remove it from our site. Trax in Space has always been on alert for songs 
with possible copyright infringement. Often other artists or site visitors inform us 
of possible infringing songs. If we find songs that are reported to us to indeed be in 
violation of any copyrights we will remove them.

Q. If my track is found to have copyrighted samples and I am unable to replace it with 
an alternate version within 30 days, can I get more time?

If you need more time please write to [EMAIL PROTECTED] 
<mailto:[EMAIL PROTECTED]> and explain why you need more time. If we do delete 
your song after 30 days you can always re-upload a legal version to us at a later 
date. Your stats for the song though will be lost. Meaning its position in the charts 
and its download numbers.

Q. What types of samples are considered to be illegal to use in my songs?

Most samples from movies, television shows, other performers, games, advertisements or 
commercials, etc. that you do not have proper permission to use are considered 
illegal. There are many royalty-free samples and sample CDs available that you can use 
in your music instead.

Q.  What could happen if Trax in Space were to be sued for distributing my songs with 
copyrighted samples?

Trax in Space is not liable for your music; instead you are liable for your music.  
This means that you can be sued.

Q. If I continue to upload songs with copyrighted samples after I�ve already had one 
removed and replaced, what will happen?

You will be removed from Trax in Space.

Q. I didn�t think my song was violating any copyrights, why was it removed?

We may have had reason to believe that your song was in violation of copyrights. You 
need to provide us with proof of your distribution rights for the song.

Q. If any of my songs are in question, how can I prove it�s mine?

Document where you received your samples. If any were copyrighted please provide us 
with written permission from the legal copyright owner.

Q. What happens if I find a song on Trax in Space that I believe has copyrighted 
samples?

the song name, artist name and a description of what you believe is copyrighted.

Q. Someone has ripped my song, what should I do?

Report it immediately to <mailto:[EMAIL PROTECTED]>[EMAIL PROTECTED]</a>  and 
we will put the song on hold. We need to know the title of your song and the title of 
the song that you believe is a rip of yours. Trax in Space keeps the exact time and 
date when songs are uploaded. This will help determine who released the song first; 
please note that the upload date is not necessarily the only factor considered. If we 
do determine that the song is a rip we will remove it.

Q. I got my samples from another song. I did not know the samples were copyrighted.

The responsibility is still yours! You need to be very careful about what samples you 
choose to use in your music.

Q. I heard a song on the radio that I liked. Can I re-make or re-mix it and upload it 
to Trax in Space?

Once again it is your responsibility to determine the legal impact. However if your 
song is suspected to be violating any sample copyrights you will be asked to provide 
proof of permission to use the samples.
