[MP3 ENCODER] Fraunhofer patents

I'm still trying to get my head around the validity of the Fraunhofer
patents in Europe. As far as I know, software patents are not yet
recognized in Europe (although there seem to be pressure to adopt them).
Is it possible the that Fraunhofer patent only applies to hardware
encoders?
