Well, if you replace average noise with maximum noise, then you will
end up in LARGE vbr files. And if there is not so much difference
between average noise and maximum noise, then our psy model works 
just fine. Only these strange situations when the difference is large,
because we have one outstanding frequency line within a band,
make Lame problems.

Maybe this is it:
 * why side channel sparsing didn't work?
 * why we make some extras at low bits? (increasing db_lower ie.)

If you like it, how about introducing a paranoid mode -- -V0 by now is
nearly such mode I think--, where distortion is always the maximum 
distortion instead of the average distorion?

If I encode them with "lame -V6 -X5 -Y -Z -k -d gspi35_?.wav" at 
the cutting edge of Lames psychoacoustic, then I get very audible
artefacts, which we had discussed earlier. My last patch helps a
lot reducing them.
If you still notice artefacts, you could increase the 1E-7 
threshold a bit.
