The last I visited this subject was at legislature two sessions ago. Current state law as Mr. Kushner describes is correct. But that is not the whole story. HUD/Sect 8 is voluntary. So says HUD and so says administrative law rulings since the '70's. These matters were first brought up when HUD gave birth to Sect 8 in 19754-5? It has been bandied about the capitol halls that Legal Aid or some such organization should find a test case and proceed with trying to trump fed law with Minn Statute 363. Current documents from HUD state clearly that Section 8 is optional. Minnesota Statute/Constitution has more protections for "public assistance" then federal law/constitution. That leaves a gap between fed and state laws locally, that most states don't have. It causes longer leases, higher legal fees, more continuing ed, and eventually higher rent-real estate costs.
