The solid orange fencing is a requirement of a permit obtained from the Minnehaha
Creek Watershed District.  The fencing is used for the purposes of erosion control
when soil is disturbed to prevent surface runoff into our stream and water resources.
Erosion control is important because pollution particles cling to sediments and
filling our lakes with sediment is undesirable.

In the past, these fences were typically black.  Orange is ugly and unnatural. It was
my idea to make them orange specifically because it is undesirable.  So often, I have
traveled around our state and seen erosion control fences which were put in place for
a construction project and left there long after the project was completed.  The
requirement by the state and the watershed district is that fencing can be removed
after the soils are stabilized and vegetative cover has been established. My goal in
requiring orange was to make sure that removal occurs at that point.

While I am on this topic, I want to let you know that if you see silt fences which
are laying on the ground in areas that continue to need protection from runoff during
heavy rains please contact our office at 952/471-0590 so that our enforcement staff
can check on the site. Erosion protection is of huge importance in good water
quality!
