The federal government has not been doing its job on this matter but it is just the tip of iceberg when it comes to the private vs. public equation. Private schools rarely have the athletic facilities or after-school programs that public schools must support; then there's the luxury of expelling problematic students....public schools are forced to hire counselors and staff to handle truancy issues that simply don't exist in private schools or the magnet schools (because it is a privilege to attend and not a legal mandate).
