Biernat's request to stay prison sentence is denied

A federal judge has denied former 
Minneapolis City Council Member Joe 
Biernat's request to stay out of prison 
while he appeals his conviction for 
public corruption. 

U.S. District Judge Ann Montgomery said 
in a five-page filed Tuesday that the 
questions Biernat plans to raise in his 
appeal -- largely concerning the 
circumstances surrounding two statements 
he made to the FBI about receiving free 
plumbing work -- had already been considered 
by two judges and a jury. She said the 
questions don't meet legal standards for 
staying a sentence.
