All of the conversation on this matter is totally inaccurate especially any notion that the city
has received a threat of litigation from Sherman Associates. Marchant Investment, the owner of
the property in question has been damaged by city action over the past six years. The Council
Members who were in office dating back to that time are aware of this and the patience that
our company has shown. Marchant may be damaged additionally if River Run is not approved.
This has been pointed out to two elected officials as one of a number of options available to the
city and the property owner to reach some agreement that is acceptable to all concerned including
