On behalf of 9th Ward City Council Member Gary Schiff: Duigi's: Health and Fire Code, not licensing Prior to purchasing the building in 2002, the current owner sought an inspection from the City and was given erroneous information from a (former) employee leading him to believe that the building was up to code. Subsequent inspections turned up numerous, long overdue, fire safety and health code issues. This is not a licensing issue. Although the City offered flexibility with the time needed for repairs (up to five years), the owner has decided that it is not financially possible for him to repair the building -- the restaurant's slow sales would never allow him to pay off additional debt. Sadly, the owner has decided to close the business and seek a buyer for the building. Duigi's will be missed, but hopefully a new owner will bring a new restaurant to the growing 38th Street community corridor and the building owner can recoup his losses in the sale price. For my part, I've made sure that the City is now out of the business of providing free inspections certifying that a business is up to code. We don't provide this service for homeowners, and since the Duigi's situation came to light, the City will no longer be doing this for commercial properties. Instead, a private appraiser can look at code issues, and the property owner and buyer can use this information when negotiating a sale price, much the way private home sales are handled.
