I am referring to discrimination that is not based on race but generally has 
a greater negative effect on people of color than whites, and may allow those 
who are doing the discriminating to consciously engage in covert, race-based 
discrimination. Examples: ability-grouping practices in the schools, requiring 
a spotless driving record as a condition of employment (e.g. letter carriers 
in the US Postal Service). 

I have seen and heard about landlords sign lease agreements with the first 
qualified white applicant, then do a background check to verify that the 
application was truthfully answered. The same landlords would tell African-Americans 
that the background check had to be completed before signing a lease 
agreement, and would charge them a nonrefundable fee for the background check, then 
rent to a white. That's an example of the covert racial discrimination that goes 
on in the housing and job markets that should be addressed, but is not being 
addressed.
