Pat Anderson is not an attorney for the State, nor is
she charged with speaking to the legality of campaign
literature. Even if she were, she is not in a position
to adjudicate the legality of ANYTHING, she is only
offering her opinion, for what it is worth. In my
opinion, it is worth very, very little.
Should the state choose to make a legal issue of the
Rybak mailing, then AG Hatch will be the official
charged with making an initial determination that the
mailing violated state law. Not to mention the fact
that since this is a campaign issue, the CFB would
most likely be the appropriate forum to make and
adjudicate a complaint.
Auditor Anderson should also advise (if that is her
proper role, and she is not simply freelancing) on the
legality of nearly EVERY piece of informative
literature I've received from several units of
government, such as the piece I received last week
from CM Schiff (prominantly displaying his picture),
or for that matter the little bulletin with pictures
of the city council that I used to get from the City
of Sauk Rapids when I lived there in 2002.
This may be the most contrived political "controversy"
I've ever heard of.
