Wendy's appealed the Planning Commission's denial of a Conditional Use
Permit for a fast food restaurant at 325 E Franklin Ave.

On 4/7/05, the Zoning and Planning Committee voted to send the Wendy's
appeal to Council without recommendation.  The Council sent the matter
back to committee, and on 5/5/05, Z&P again voted to send the appeal to
Council without recommendation.  Both Council Member Zimmermann and
Council Member Lilligren were present at both of these committee
meetings, and spoke in favor of upholding the Planning Commission's
decision.  Unfortunately, they were not "on the prevailing side of
voting it down;" there was not a successful vote to deny the CUP at
either Z&P committee meeting.

At the 5/13/05 Council meeting, Council Member Zimmermann moved to deny
Wendy's appeal and presented findings to support the denial.  Council
Member Schiff moved to grant the appeal with staff findings.  Council
Member Schiff's motion passed.  This is the meeting from which Council
Member Lilligren was absent.

In response to the community concerns raised during the Wendy's
discussions, Council Member Zimmermann introduced an ordinance to add
the Pedestrian Overlay to sections of Franklin Avenue and Nicollet
Avenue at the 6/17/05 Council meeting.  This amendment to the Zoning
Code requires an in-depth and deliberative process with CPED staff and
community members.  Right now, it is 9th out of 18 Zoning Code
amendments on the docket.  The Zoning Code amendments will be ranked
again once the 2006 budget, and therefore staffing levels for Planning,
is established.

Once again, I feel the need and obligation to correct fallacious claims
made
against Council Member Lilligren by the Zimmerman campaign and give a
clearer perspective of Dean's service to the Sixth Ward. Jenny Heiser
and
Lauren Maker have accused CM Lilligren of misrepresenting his position
and
voting record on the Wendy's drive through development at 24th and
Clinton.
In committee, Robert led a thoughtful discussion on the shortcomings of
the
Wendy's proposal and was on the prevailing side of voting it down.
Wendy's
then filed an appeal, which was granted as the final council action.
Council
VP Lilligren was absent at that meeting due to a previous government
leadership obligation at Harvard.
