There's what the ordinance says and what many of us who were around at the

they felt that they were setting a very high threshold in order to vary from
the limits in the Shoreland Ordinance.

These ordinances say that buildings are limited to 35 feet tall within 1000
feet of our waterways, and were passed after the awful Lake Point building
was built that destroys the view from the east side of Lake Calhoun, the
most used part of our chain of lakes.

Below I've included the section regarding heights of structures within the
Shoreland Overlay. My questions are as follows:

(a) Has 551.480 been changed since it was created?
(b) How does 551.480, specifically the four additional factors, come off as
setting a very high threshold?
(c) In terms of character, if tall buildings already dominate the character
along Lake Street on the NW corner of Lake Calhoun (whether wanted or not),
then what sort of argument would one make for factor (3) from 551.480?
(d) Regarding Lander's proposal, what are your feelings regarding CIDNA's
compromise or Lander's compromise? (CIDNA would be willing to have 84' and
70' given the context and some other conditions; I'm not remembering what
Lander's compromise was...)

Lake Point was built, whether it should have or not. I walk that part of the
lake a fair amount and I can tell you that Calhoun Beach Club (both parts),
Lake Point, Calhoun Exec Center, and the four or five 6+ story buildings
just to the SW of Calhoun Exec Center already dominate the view from the
east side of Lake Calhoun - well that's if you choose to look at the
buildings rather than the Lake, the people around it, and the 6-lane road on
the north side.

Looking for clarification over in CARAG

------------------------------
551.480. Height of structures.
The maximum height of all structures within the SH Overlay District shall be
two and one-half (2.5) stories or thirty-five (35) feet, whichever is less.
The height limitation of principal structures may be increased by
conditional use permit, as provided in Chapter 525, Administration and
Enforcement. In addition to the conditional use standards contained in
Chapter 525 and this article, the city planning commission shall consider,
but not be limited to, the following factors when determining maximum
height:
(1) Access to light and air of surrounding properties.
(2) Shadowing of residential properties or significant public spaces.
(3) The scale and character of surrounding uses.
(4) Preservation of views of landmark buildings, significant open spaces or
water bodies.
