Good point Mark. I discovered the cause of my issue. If you install a 2007 client without specifying a management point, it will attempt to query a 2012 site server, even though it cannot talk to or recieve policy from an incompatible client version.
The problem stemmed on new builds where we didn't specify the MP or if we clicked the 'Discover' button.
