Actually in some states it might be illegal to charge a fee for using
the credit card.. I know I read that somewhere.. if I get a minute
I'll do some googling.. just like exp dates on GC's are against the
law in some places.. I am thinking the same applies here..

Remember, being illegal and against TOS are two very different
things. Square could simply drop you if they learned you were
passing on a fee, but there are no legal ramifications.
Set your pricing based in credit and debit card purchases, and offer
a discount for cash or check. It's as simple as that.

Rhonda, I totally agree with what you are saying...when I lived in
Florida I had Credit card merchant services and it had the same
clauses..... but it burns me up that the gas stations charge more
and even my Dentist, down in Florida did also...HOWEVER, .the
dentist anyway, said they weren't charging a fee for credit card
use... they were giving a discount for cash! SO...I guess it is all
in how you word it!

Subject: Re: NailTech:: Re: The Square Questions
It is strictly against the Terms of Service to pass on any fees to
the customer.
12. Applicable Network Rules.
The Networks require that you and Square comply with all applicable
bylaws, rules, and regulations ("Network Rules"). The Networks have
historically reserved the right to amend their rules and
regulations. Square may be required to change this agreement in
connection with amendments to the Network Rules. Significant
portions of the Network Rules are available to the public at
<http://usa.visa.com>usa.visa.com and
<http://www.mastercard.com>www.mastercard.com.
Network Rules currently prohibit you from (a) assessing a surcharge
for the use of a Card in connection with any transaction, or (b)
dispensing cash on any Card transaction. The Rules also restrict
your use of Network logos to indicating your acceptance of the
Network cards and to other uses expressly authorized by the Networks.

All you have to do is charge the fee to the wrong person and you
are opening a big old can of worms for your business.
