Taking Team Names to Court

The Redskins case is the leading edge of a wave of Native American
efforts to eliminate Indian-themed sports team names through creative
legal methods.

A challenge to the Atlanta Braves' trademark by the Native American
Resource Academy, a Fort Lauderdale, Fla.-based group, is pending before
the U.S. Patent and Trademark Office's Trademark Trial and Appeals
Board, said board spokeswoman Brigid Quinn.

In Cleveland, the National Coalition on Racism in Sports plans to file a
racial discrimination suit next week challenging the Cleveland Indians'
name and mascot, said Vernon Bellecourt, the group's president. The
plaintiffs are likely to use a new theory, first broached in a Harvard
Law Review article this year, that the baseball team's "Chief Wahoo"
mascot and related paraphernalia effectively exclude Native Americans
and deny them full use of the team and sports arena.

More than 600 high school and college teams, including Stanford
University and the Dallas public schools, have scrapped Indian-themed
names, and many of the more than 2,500 institutions that still use such
mascots are under pressure to follow suit.

The U.S. Justice Department recently investigated whether a North
Carolina high school was creating a "racially hostile environment" by
using Indian names for its teams. Last month, the investigation was
closed after the Buncombe County school board agreed to drop "squaws"
for Erwin High School's girls teams.

"At some point, there aren't going to be any Indian team names anymore,"
said Nell Jessup Newton, dean of the University of Denver law school,
who studies constitutional rights and Indian law. "That's social change
. . . and I think it's good."
