The ground is very simple if an user link to an page where law conflicting stuff is, the firm can go to the page or also to the user who links. So why not do the same on spamming. Let all user protest there the provit of the spam goes to, if it's the wrong firm so it's there trademark and they they should not only have rights frome an trademark but also things to do, to make sure that its not used for spamm.
