Patent trolls cant exploit public domain software as it would count as 
prior art.

Crony capitalism might be more appropriate. In a truly capitalistic 
society, a naturally bounded balance of closed and open software 
would exist, with the closed makers (imo) being in a very narrow 
minority. Even in the present scenario if blatantly illegal (as 
already decided in court) deals, licences, non-refund on bundled 
goods etc were imposed with disgorgement, most closed software 
vendors and a large number of hardware vendors would be bankrupt by 
now.
