1. Copyright for anything written in the course of employment (i.e., as
part of employment) vests with the employer, unless there is a contract
to the contrary.

2. The government owns the copyright of all works produced by the
executive, the legislature, and the judiciary, as per the Copyright Act.
 (Let's not get into the complicated question of copyright over laws and
judgments, as it is fair to assume that for all practical purposes they
are in the public domain, though technically that is not true in India.)

3. There is a limited exception to this in s.52(1)(q) of the Copyright Act.

All of this is covered in a fair amount of detail in CIS's 'Report on
Open Government Data in India'.
