IANL, but if you can see something from the air, at least in the US, I don't see how someone can have an expectation of privacy.
Most of my mapping has been done off of air photos, so mapping a pool does not require trespassing. I like seeing the pools and other things like that on a map because I think that they can help one quickly orient oneself to an air photo. Maybe they shouldn't show up in the default render for navigation purposes, who knows. In support of relief or emergency activities (wild fires), pools could be beneficial data. David.
