********************************* Urge Congress to STOP Lawsuit Abuse Lawsuit abuse by "serial litigators" is bankrupting companies and putting doctors out of business. It's costing jobs and stifling innovation. It's preventing the development of new products and services. In short, it's a cancer on the American economy -- estimated by Forbes magazine to be costing the nation more than $200 billion per year. "Manufacturers, insurance providers, physicians and service providers face enormous potential liability penalties should they fall afoul of persuasive lawyers and indignant juries," writes Neil Hrab of the Capital Research Center in a study of the trial lawyer lobby. "And the costs they incur defending themselves drain away funds that could go to creating new jobs and fuelling research into new products." Physicians appear to be particularly susceptible these days. "Doctors spent $6.3 billion for malpractice coverage last year," according to a study from the U.S. Department of Health and Human Services. And "many doctors now engage in 'defensive medicine,' ordering tests and consultations simply to establish a defense against a potential lawsuit." President George W. Bush is keenly aware of the crisis surrounding the abuse of medical malpractice lawsuits and is seeking legislation to address it. So are many governors and state legislatures around the country. "The problem of those unnecessary (medical) costs don't start in the waiting room or the operating room," said the President in January. "They're in the courtroom. Everybody's suing, it seems like. There are too many lawsuits in America, and there are too many lawsuits filed against doctors and hospitals without merit." To make matters worse, the supposed "victims" often come up with nothing to show for their efforts. "Trial lawyers appear more intent on mining the legal system for personal gain rather than compensating the victims of accidents," notes economist Wayne Brough of Citizens for a Sound Economy. "It is estimated that 57 to 70 percent of claims generate no money for the patient, which suggests an excessive number of lawsuits are being filed." All of which ultimately results in higher costs, higher prices, higher insurance premiums and higher taxes on everyone in the country.
