I've found a better solution:

Still I did not manage to put that rule in a xmlsetsetup.
Tried this:
\xmlsetsetup{#1}{p[reverse-sibling::p[1]/attribute('class') ==
'incipit']}{xml:p:noindent}
but it does not work.
