In the USA, I think there is still a lot of case-law that needs to be established about who owns and can access your data. These things are slowly getting through the courts.
Until those decisions are made, and in the case of multi-jurisdictional issues as you point out, I'm still seeing a lot of resistance. On the other hand, small customers of mine with little proprietary data (if any), already using SalesForce and Quicken Online - they think Office 365 is great! I'm also becoming less convinced of Microsoft's capability to respond to customer requirements, although to be honest that's exhibiting more in the consumer end at the moment than business.
