FWIW, 8.1 said the Start "button" would return, not the Menu. Dodgy advertising I agree, but they never said the Menu would actually be there.
And it was the press who jumped on 8.1 U1 as the return - MS just said it would be in a forthcoming update IIRC. Although I'm not really defending MS - they could have handled this infinitely better.
