The problem is that the Palm Pre was working by telling iTunes that it
is an iPod. I think it seems reasonable that Apple would not take
kindly to another company's device representing itself that way. It
doesn't really rise to the level of copyright infringement, but it
certainly is ethically suspect.

As for why Apple has a bit of an issue with Palm is twofold, I think.
The first is that Palm has been soaking off Apple engineers. The second
is that Apple believes, and I think rightly so, that major parts of
WebOS is ripping off iPhone tech, which they have patented the heck out
of. Palm is basically daring Apple to sue them.

As for the "open" comments about Apple. Apple absolutely does play
nicely with open standards; you should do some research. That isn't to
say that Apple hasn't taken some open source software, modified it and
kept the changes to themselves. Of course they have, but nobody has
ever accused them of doing anything not allowed by the license
agreement. Does Apple do open source and contribute back out? Ask
Palm. They are using WebKit in the Pre.

Well, there was the issue that the Pre would only sync DRM free music.
Is iTunes all DRM free now? I don't buy from iTunes often enough to
know, so there are issues of users interatcing with iTunes in a way
that's not consistent with iTunes users typical experience. Apple is
and always has been about controlling the user's experience as much as
possible.

What open stuff? Open standards, not so much. Open software, sure if
they can use it and not have to give back, it's great.

You may think it's a hasty, bitter decision, but it was one that is
entirely consistent with Apple's behavior. It goes to show you that the
"former Apple peeps" at Palm shouldn've known better.

Now this: Why wouldn't Apple play nicely, and enjoy profits
from all the Pre users that are now using the iTunes Store to purchase
Music, Movies, etc...? Jobs always talks up this 'Open' stuff... Maybe
they are losing their way? I think it was a hasty, bitter decision
since their peeps are now working for Palm.

I'm going to call your statement horse hockey.
On their May 28th press release Palm wrote, "Palm media sync is
a feature of webOS that synchronizes seamlessly with iTunes, giving you
a simple and easy way to transfer DRM-free music, photos and videos to
your Palm Pre." That was the first sentence of the 2nd paragraph, where
the first paragraph was a description of the demonstration and
demonstrators at the All Things Digital conference.
(Link:http://investor.palm.com/releasedetail.cfm?ReleaseID=386488)

So, Palm did think iTunes integration was a big deal, since it
was the first thing they mentioned about the phone in that release. If
they had some former Apple peeps, then those peeps should've known that
this hole in iTunes would be quickly closed by Apple, and probably had a
good idea of how quickly it could be closed. I don't think I'm
stretching my logic too far, either.

So the situation we can deduce, is Palm's marketing department
creating buzz around a feature that everyone at Palm knew (or should've
known) would be squashed. I'm actually suprised it took Apple as long
as it did to close the hole.

If my description of some reasonable suppositions isn't an
example of a company who lost its way, I don't know what is.
