Like anything else, it depends on the licensing. We purchased some royalty free music on CD from Manion Music (http://www.manionmusic.com/), ripped the CDs, and put the MP3s on an ipod shuffle (1st Gen). The ipod is plugged into a wall charger and is set on random, and it has been playing for years with little to no issue. It serves as BOTH MOH and BGM.
As for Satellite, we're doing that too. They offer a commercial subscription that allows you to legally do exactly what you described. We've installed both XM and Sirius. (Different facilities, different preferences on content - like everything else, it is political). As for not getting caught, I acknowledge that the risk is low, but I wouldn't take the chance. We had an entity in the next town over from us get busted by either ASCP or EMI, I forget which, and it cost them well in excess of 6 figures. Yes, six figures. I'll try to find the aticle.
