I think the answer to the question "can someone create a node..."
is, yes, you can - you may, etc.

In the simplest definition, a node is
a Wifi/wireless access point that one
can use without paying for it.

Some nodes are wide open, like in Bryant Park, etc.
Others may require an email to get a password.

A node can be just an access point connected to the Internet,
or it could be an access point connected to the Internet via a
special gateway....

For your security, it may be wise to have a
Captive Portal page that users must see before
using the service.

NoCat is the original Captive portal for wireless,
and is included in pebble Linux distro.
Pebble can even be used as an Access Point.

m0n0wall is a FreeBSD distro that has a captive portal,
which I am using as an AP.  It includes many extras,
like PPTP and VPN.
