Micha My name is Michael Muller and been living in OBS for 8 years. I read your letter and want to give you an answer to "why now"?
After a specific event at one of the pubs in Lower Main Road, a meeting was organised with affected residents and the attendance was overwhelming. 18 residents signed sworn affidavits with Insp. Nel (SAP). A record of residents, who want action against noise nuisance, was listed. This list is growing every day! More than 30 people (households) already. I took the matter (affidavits & petition) to the OCA (Observatory Civic Association) with Cnllr. Thomas present and we discussed the matter. We now have two options. Join the OCA and run this through them or start our own committee against noise nuisance in Observatory. We are involving the SAP and Cape Town City Health to help us enforce the "City of Cape Town - BY-LAW RELATING TO STREETS, PUBLIC PLACES AND THE PREVENTION OF NUISANCES". You see Micha, this is not only me! The residents of OBS are standing up against the sleepless nights they experience. We have set up a SMS-system to where residents SMS me whenever they are affected by noise coming from pubs/clubs in OBS. Then at 2am i get into my car to investigate the complaint. That is when you see me driving up and down Lower Main road. I involve the SAP when music is audible on the street. (See BY-LAW RELATING TO STREETS, PUBLIC PLACES AND THE PREVENTION OF NUISANCES) Sorry, but this is ALL we (the residants) have to protect us. Follow this link: http://www.capetown.gov.za/en/ByLaws/Documents/By-law%20-%20City%20of%20Cape%20Town%20By-law%20Relating%20to%20Streets%20Public%20Places%20and%20the%20Prevention%20of%20Noise%20Nuisances.pdf Micha, i don't know you at all, but i believe everything you said in your letter. But that night the music coming from The Scrumpy Jack was too loud. We do not target anyone specific, we target noise nuisance. We do not want any business to close down or feel unwelcome in OBS. We have to co-exist and at the moment the scale tips over way too far. And yes, i do have better things to do at 2am. You see, every morning at 6:30am, our 20 month-old boy wakes up to a brand new day! I bet you are then still under the covers...? My best wishes to you and your family. Good night and sleep tight!
