  Attached please find a copy of notice[s] of application[s] for liquor 
licence[s] submitted to the department of Trade & Industry in term of the 
Liquor Act, 1989

   

  Under notice number 628 of Government Gazette 32264 dated 5 June 2009, Three 
(3) application[s] for removal of liquor licence within the area of 
jurisdiction of Subcouncil 15 was advertised for comments within twenty-eight 
(28) days from the date of publication of such application. 

   

  The City Council in terms of delegation 51.1 instructed Subcouncils' to 
comment on applications on liquor licenses to the relevant Liquor Licensing 
Authorities.

  The following are brought to your attention:

  ·         The granting of applications for Liquor Licenses is not a function 
of Local Government as such at this stage. 
   

  ·         However, local communities often approach their Councillors in the 
case of nuisances caused by Liquor Outlets especially those near or even inside 
residential areas and the opinion is held that Councillors, especially  Ward 
Councillors should have the opinion to comment/object or request the imposition 
of conditions in respect of any new application or transfer of liquor licenses. 
This action is seen as part of the broader civic responsibilities of Council. 
The right to comment on such an application is protected in terms of current 
Legislation on Liquor Affairs.

  ·         Mention is to be made of the fact that any individual as such has 
the right to object/comment/request the imposition of conditions as far as 
Liquor Licenses are concerned. 

  ·         In terms of a delegated authority, a communication was addressed to 
the Development Co-ordinator Town Planning, Cape Town Administration and 
Principal Environmental Health for professional input/comment regarding zoning 
regulations and business/entertainment licence verification.  The opinion is 
held that these Line Departments have a duty to object to any application where 
the correct zoning/licensing is not in place for the type of license for which 
application is being made.

  Community organisations/residents may submit comments to this office, to aid 
in the decision taken by this Subcouncil. 
   

   

  This Subcouncil would also encourage community organisations/residents to 
submit comments directly to the Chief Magistrate and the Officer Responsible 
for Liquor Affairs at the South African Police Services, of the area concerned.

   

  Details of the relevant Chief Magistrate and the Officer Responsible for 
Liquor Affairs at the South African Police Services, of the area concerned are 
included below.

   

  Feedback on the outcome of previous applications can be sought from the 
Officer Responsible for Liquor Affairs at the South African Police Services or 
Chief Magistrate of the area concerned.

   

  Written comment in respect of the attached notices of application[s] must 
reach this office before or on 26 June 2009.
