Hi Micha,

Sorry to hear this happened. I suggest you set up a meeting with the
Station Commander and the DPO to clarify the the officers
attitudes. Unfortunately the new liquor law is very strict on
the consumption after hours ( even if the drinks are complimentary) so your
barman's half beer is technically illegal. Here are the extracts from the
relevant sections:

*Western Cape Liquor Act No 4 of
2008*<http://www.google.co.za/url?sa=t&rct=j&q=&esrc=s&source=web&cd=1&ved=0CGMQFjAA&url=http%3A%2F%2Fwww.fedhasa.co.za%2FDownloads%2FWestern%2520Cape%2520Liquor%2520Act%2520No%25204%2520of%25202008.pdf&ei=Jr4TUILmIMrAhAet-IGgDw&usg=AFQjCNHazW-5J5rcBS3bMDZ_ZSHtQqandA&sig2=IGwUbBCSkIOodfsl4g2Sww>

*Trading hours*

*59 (8) Subject to section 89(10), a licensee who sells or supplies, or
allows the*
*consumption of, liquor on the licensed premises at a time when the sale of
liquor is not*
*permitted by the licence, is guilty of an offence.*

*Transitional provisions*

*89 (10) Any licence issued prior to the commencement of this Act for
premises on which*
*liquor may be sold for consumption either on or off the licensed premises
which*
*authorises trading beyond the trading hours stated in section 59(3) is
after twelve (12)*
*months from the date of commencement of this Act subject to section 59.*

So all in all they were just doing their job, even if they could not
explain it is a clear way. There is no case for not allowing people on to
the premises. Just make sure no consumption takes place. Unfortunately due
to abuse of the old liquor act these clauses were inserted to make it very
clear.

Hope that clears it up for every one, patrons and publicans included. When
the barman tells you stop drinking please make his job easier by
understanding the law.Staff may not consume alcohol after hours.
