Maybe.  The OGB doesn't own the trademark, but owning the trademark
isn't really sufficient to declare that the OpenSolaris Community has
endorsed XYZ as its binary distribution.  At best it would conflict
with the Charter, but since there's no one in a good position to sue
and they hold the trademark they'd need, they'd likely get away with
it albeit at the price of OpenSolaris's credibility as a
self-governing community.

However...it's premature to speculate, and I haven't yet seen an
indication from Sun that this is their intent...personally, I think
the occasional misrepresentation is the result of an innocent
misunderstanding and some poor communication within Sun.  Some of us
have mentioned this to people within Sun in a position to correct it,
and I'm fairly confident we'll find a mutually satisfactory solution.
