It works upstream, as I understand it. This is why it is well worth a publisher's time 
to make sure any OGC he is drawing from is handled properly before adding it to their 
own work. The reason being that, regardless of whether you're using someone else's OGC 
or using your own, new OGC content, if the content is stepping on somsone else's toes 
then it is stepping on someone else's toes, regardless of the source. The ultimate 
state of compliance is the bottom line.
