Don't forget that WotC is allowed to give people permission to do
things that they are not allowed to do by the OGL (or the d20stl). I believe
that Dragon magazine used to be owned by TSR (as well as another one called
Dungeon). I don't know if WotC have kept this as in-house or got someone else to
franchise the name (like they have with Ravenloft) but the Players Handbook that
I have has caries an advert for Dragon in the back that says it is the official
magazine.
WotC could easily allow Dragon to publish both OGC
and reviews containing words that are prohibited by the OGL in separate
articles. As far as I know Dragon wouldn't
be
legally bound to inform the world that they had been granted extra privileges
*if* WotC gave them some.
WotC have made other agreements with people that let them do
things not allowed by the OGL or d20stl. If you look at their website you will
see official fansites for all the campaign settings TSR sold that they have
dropped. I'm fairly sure that some people would say these websites would be
illegal if they didn't have special permission.
