It seems to me that much of the
local traffic is speculation, an appropriate intellectual tool to be using
in an emerging field.
While I don't agree with you that footnoting and attribution is a top concern re: the OGL, I do agree with the above sentence.
While I am not for hysteria, moderate speculation and asking "what if" is the basis of much learning. Particularly regarding a license, I think it is really useful to ask "what if" to see how various interpretations and scenarios play out.
I think it's important to ask opposition questions too, not to haze people with opposition questions, but to double-check that the accepted standard logic is really valid, and to see if it is subject to logical counterattack or based on false premises. I view such exercises in logic as just that -- exercises in logic. I think they have utility. Clearly the mileage of some may vary.
While I may not agree with your assumptions on some things, I don't reject your right to ask the questions or raise the issues.
