Unless you created and used entirely new monsters. I think we'll be able to
present several "basic" monsters in the first D20SRD release so you can see
how the monsters are templated and use the same format in other products.

It's possible that we could potentially get most of the monster Feats
finished up and several dozen monsters ready for release with the first
batch of PHB stuff to enable people to get right to work on adventures. If
that's doable, I'm all for it. I'll have to check with R&D.

Even if you waited for the release of the MM components of the D20SRD, you'd
have them in August. For a "traditional" publisher, that would be a problem
because the solicitation cycle through the hobby distributors can run about
three months and the first products wouldn't hit shelves until October or
November. But for a new publisher in this particular area, I'm betting the
cycle time is going to be very compressed.

In fact, I expect that there will be people who will be ready to publish D20
based stuff >at GenCon< based on the PHB. I wouldn't be surprised to see
some adventure content appear for sale on Friday (or even late Thursday
afternoon) after a quick trip to Pip Printing...

The problem is time-to-review in legal. They're incredibly busy right now
with a ton of unrelated matters and it just isn't clear to me when we'll
have time to do an exhaustive review of the trademark licensing rights.
There's no way to short-circuit that process; it needs to be done regardless
of the type of licesning.

A mistake in this area could cause us to lose control of the D20 Trademark
or make it impossible for us to register it with the PTO. That's a pretty
negative side effect.
