Clark,

I made a lawyer joke a long time ago when you flamed
me and I apologized for it. I'll apologize again.
I've made plenty of digs at you in response to digs
you've made at me. Childish I admit and I will try
to stop doing that.

I feel expressing an opinion, unpopular as it may be,
does not deserve the personal attacks that have been
happening. Especially not from someone who just got
back on his moral high horse after being asked to check
his website for trademark abuse (wasn't meant to be a
dig but to explain my state of mind).

With regards to the Mayfair vs TSR case, I made a brief
summary and stated up front I did not understand half
of it. Any commentary or implications made by other
people on this list are not mine. The only commentary
I added was Mayfair had an agreement on trademark usage
with TSR and they were sued. WarGames West didn't have
such an agreement and they were not. While many other
factors contributed to this happening, the agreement
certainly provide TSR more ammunition in legal action
versus Mayfair.

If you are reading into the new OGL clause some sort of
tacit agreement, I urge you to reconsider. If you don't
use any WotC trademarks with or without the new clause,
they won't sue you. On the other hand, the new clause
makes it more likely they will sue you if they are unhappy
with your website or publications.

Regards,
--Kal
