Subject: RE: [Open_Gaming] Trademarks and Me

<< Step back and take a look at the big picture for a moment. Who is holding
the copyrights to the license? WOTC is. This means that if somebody
makes a liberal interpretation of the license, and does something illegal
with it (such as violating copyright or trademark laws), and says that they
did so because that is how they interpreted the license, then the plaintiff
can turn around and sue WOTC for creating this confusion (though I
suspect a more distinct suit would be filed). >>

GOOD point. Never forget that some plaintiffs and some attorneys
(particularly the less scrupulous attorneys) believe in the "deep pockets"
theory of selecting a plaintiff: "Lemme see... NoName Games has a net worth
of $257, counting the 15 crates of stock in their garage -- oops, I mean
'office'. OK, Wizards of the Coast is a division of Hasbro, Inc., which has
a current market cap of around $4 billion. Ya know, I REALLY think NoName
Games was misled by the evil folks at WotC, so we ought to sue Hasbro.
Ka-CHING!"
