*I* can't. Not without getting a US/international IP lawyer to ensure that
any trademarks etc. that the licensor possesses in the property that they
are licensing aren't destroyed or compromised by careless D20/OGL

As J. Michael Looney has noted, the D20SRD is being extracted from D&D
3E. WotC can directly use the D&D3E material and can stick the d20 logo on
anything they publish which belongs solely to them without having to worry
about the D20 and OGL licenses.
