I agree that it would be difficult for WotC to revoke the policy. Enforcing
it now would however be easy. The policy is restrictive enough that, without
exception, all of the sites I have visited in the last six months would all
be in violation of the posted policy. That is what I believe Ryan was
talking about. Not that the policy allowed them to do illegal things but
that they claim that it does.

IANAL either but I have spoken to a member of the Bar with eminently 
respectable credentials in IP about this very issue, and her take on it was 
that WotC would not have a leg to stand on in court on this issue.  Her 
feeling was that WotC would have a *very* difficult time >legally< revoking 
the online policy.
