There will almost certainly be parts in WotC's books that would be OGC if 
they weren't proprietary... say, "the spellfire template" or somesuch.  But 
becasue WotC wrote the D20SRD and its original works, they can do that.

As I see things, if someone else wrote a "new forgotten realms," their 
"spellfire" template would be game rules, and should be open content.


Ethically, a game producer should include enough non-game rules with any New 
Thing in open gaming to make it useable by someone else without violating 
the OGL.  I haven't read the CC, but at least some parts of "ecology" would 
be necessary to do this, in my opinion.

Other than this (having enough to support the New Thing you released under 
the OGL), there's no reason at all that you shouldn't have all of Shattered 
Lands as exclusive PI.
