As a practical matter, there may not be anyone with a commercial interest in using the term "D20 system" generically. However, it doesn't take a lawsuit to stop a trademark from being registered by the U.S. Patent and Trademark Office. Every mark is published for opposition when it is registered, and any entity that feels it would be damaged by the registration can file an opposition with the Trademark Trial and Appeal Board. It doesn't even require an attorney, just a fee of $300 per class the mark is registered under.
