There are some specific definitions of a "work" in the D20STL Guide.
They're reasonably applicable to the OGL.
The OGL is intentially vague though, because you never know what future
innovation is going to create in terms of a delivery vehicle. It will be
much easier to update the STL Guide than the OGL to address those kinds of
concepts.
So, as it stands, two parties might disagree on what constituted a "work" in
the sense that term is used in the license, and a court would make a
determination based on Title 17 and the caselaw about copyrights in this
area.
