In short: Yes.

WotC doesn't need to license the trademark from themselves (since they already
own it); so their books have no need to adhere to the trademark license.

Nor is it impossible to have a stand-alone game with the D20 trademark license.
First, not all RPGs require character creation. Second, not all character
creation processes fit the definition of character creation which the D20
trademark license is currently using. Now, whether or not WotC would immediately
change the definition the minute somebody published a game using a different
type of character creation process remains an open question.
