Why not? All OGC is based on the SRD. The SRD uses the term Halfling. CC
cannot PI the term Halfling since it was OGC in a work they derived from.
You're free to use the term Halfling in any OGC you create based on the SRD
or any other work _besides_ the OGC. If you base something on the CC and
use the term Halfling (OGC _or_ PI), you are also in breach. There would be
two ways for S&S to remedy the CC breach, open the term Halfling, or
withdraw the work. If they withdrew the work (not bloody likely, but for
purposes of dicussion), you would lose the right to base anything off the CC
and would have to withdraw your work as well.
