To speak in strict technicalities then, since most of the current third
party releases are using elements from the DMG, MM, and PH, that have not
been designated as 'released' in the SRD, are these guilty of infringement?
If so, they have not been taken to task for their trespass, and I'm very
happy to see that this is the case.
It is very encouraging to see that so far, where the rubber hits the road,
the incomplete SRD is not interfering with the early adapters who only wish
to see the OGF reach its goals.
Obviously, no one wants to see this experiment strangled at birth, and it
appears so far that as long as there is compliance with the overall spirit
of the OGL and SRD, then those of us wishing to publish in the near future
are in a safe harbor.
Is this indeed the case? To repeat: If we publish our planned d20 supplement
using elements which have not yet been designated as 'released' in the SRD,
is this infringement?
