Perhaps they're thinking of holding back a few, significant unique monsters,
such as the Tarrasque. I was a little surprised to see it in the SRD since
it's just such a PI-ey monster. I'd be a bit concerned that they might do
likewise for Mind Flayers and Beholders since there doesn't seem to be much
in the public domain close to them (though Runequest had a squid-headed
monster too IIRC). Frankly I wouldn't fault WotC for holding back it's
coolest original creations, after all, if you're a writer you should be able
to make up your own cool monsters. But I imagine a number of publishers have
already used beholders and mind flayers in published scenarios or
supplements so that would be a little bit rough to try to get back in
compliance.
