I don't know the details, but I believe that Kenzer & Co. have a separate licensing arrangement with WoTC to use the D&D IP. Certainly "Kingdoms of Kalamar" is licensed to use the D&D trademarks and they also produce the D&D comic book. I believe Hackmaster licenses D&D as well.
