I was watching for that as well, but the judge was pretty clear that she
didn't want to go there during the preliminary injunction hearing.  The fact
the MySQL folks had flown in from Sweden was a major factor, which is a nice
little reminder that all the technical finagling in the world will sometimes
lose out to a simple human equation.

The way the judge granted the injunction against trademark usage but
rejected the injunction against distribution of GPL code seemed to be a
pretty clear signal to settle - each party has something to bring to the
bargaining table.  It is probably in the best interest of the two parties to
settle, but I doubt it is what the FSF wants.

It may well be that this will set its own kind of precedent - that the
courts are unwilling to answer such technical questions at this time, and if
you want an answer you'll have to work it out for yourself.  We may have to
wait a long time for a ruling on this one.
