I think that the court is willing to get into the hairy details of the license, if the parties refuse to settle. She doesn't want to do it unless there's a real case though, because it's going to involve a bunch of expert witnesses, and probably a "special master" appointment. Very expensive, and very time consuming for something that should probably not have gone to court anyway.
